A mother illegally claimed over £22,000 in Universal Credit for five years by lying about her child’s living situation.

Katie claimed benefits as a single, jobless mother. She was forty years old, and her child was taken from her care in 2018. She didn’t tell the authorities about this.
The truth came out in 2023 during a review. Katie admitted her mistake in court.
The court gave Katie an intensive supervision order on February 13th at Birmingham Magistrates’ Court.
The prosecutor said Katie claimed Universal Credit, stating she was jobless with one child. Her child was taken in April 2018, and she did not report this change, leading to an overpayment of £22,268.
The court said Katie needed drug rehab, although her benefits were restarted. The judge said jail was possible but decided against it.
The judge explained the intensive order was different, with more meetings and monthly reviews. She added that one must tell the judge the truth, or face jail time for breaking the order.
Katie agreed to the two-year order, which included drug rehab for one year. She needs twelve mental health sessions, and drug tests are also required, with up to 25 rehab days.
The judge did not add extra punishment, saying the order was hard enough. Katie must pay a £114 victim surcharge, and the DWP will recover the benefits money.
The judge spoke to Katie privately, stating they would meet monthly. The judge wanted Katie to be honest, understanding that talking to a judge could worry people.
