A fisherman, Nathan Daley, argued about a homeless man in Penzance after drinking with friends. He punched an 18-year-old student.

The student had inquired about the homeless man, causing Daley to become defensive with his group who were sitting in a shop doorway. Daley was already upset about failing to find a taxi. The argument escalated, and Daley punched the student in the head.

The student was walking away when Daley attacked. He fell, hitting his head on the ground, suffering cuts to his face and a brain bleed. The student also lost consciousness and paramedics transported him to a hospital. Due to the severity of his brain injury, he was then transferred to Derriford Hospital in Plymouth.

After his arrest, Daley admitted to the punch, claiming he was wound up. Daley, with prior convictions including battery, pleaded guilty to causing grievous bodily harm, an event that occurred almost two years ago.

The victim suffered a fractured eye socket and nose, coupled with facial swelling. A CT scan revealed that surgery was not required, information that was shared during the sentencing. The victim stated the attack had a significant emotional impact. He now experiences fear when going out alone and of homeless people. He started drinking as a way to cope.

He now suffers from anxiety and depression, constantly worrying about a repeat attack, a situation unfamiliar to him before this incident. The attack has diminished his overall joy in life.

Daley’s lawyer explained that he is now a skipper, enabling him to pay compensation from his profits. The judge acknowledged the force of Daley’s punch, emphasizing that a single punch can be deadly.

The judge cautioned Daley against returning to court, reminding him that he could have killed the student, and highlighted the importance of Daley maintaining his employment. Daley received a suspended prison sentence, along with requirements for rehabilitation activities.

He must also pay the victim £1,500, with a twelve-month timeframe for payment.
